Online Casino Legalization in Ukraine: What the 2020 Gambling Law Requires

For more than a decade, Ukrainian players had no legal way to gamble online. Offshore sites often blocked Ukrainian IP addresses, VPN connections were frequently detected, and players who did get through risked having their balance frozen once KYC checks or a scanned bank card revealed where they lived. In 2020 the country reversed course and created a licensed market for online casinos. This guide explains how that framework works and what it means for operators.

From a blanket ban to a licensed market

In June 2009 the government of Yulia Tymoshenko banned gambling business in Ukraine. From then on, every form of casino activity, online casinos included, was illegal, and operators faced heavy fines and even prison sentences.

The turning point came on August 13, 2020, when President Volodymyr Zelensky signed Bill 2285-D into law as Law No. 768-IX. It legalized gambling business again and allowed online casinos to operate under a license, subject to a demanding set of conditions. For players, it promised a way to use licensed sites without fearing that an offshore operator would refuse to pay out.

What the law requires from online casino operators

The main conditions for running an online casino under the 2020 law are:

  • Minimum age of 21. Operators must confirm a player's age before that person can register, deposit or place a bet.
  • A Ukrainian legal entity. Only a company established under Ukrainian law can hold a license, so foreign groups cannot operate directly. Article 14(1) of the law does, however, allow foreign nationals to act as managers, accountants and ultimate beneficiaries of a licensed operator.
  • Authorized capital of at least ₴30 million.
  • A bank guarantee or capital reserve worth at least 7,200 minimum monthly wages.
  • Self-exclusion. Article 16(7) requires an online form through which players can voluntarily restrict their gambling for a period of 6 to 36 months. Casinos licensed in Malta, Curaçao and many other jurisdictions offer similar tools, usually with more flexible terms.
  • Bilingual rules. Casino rules must be published in Ukrainian and English, with other languages optional.
  • A .ua domain for the online casino.

Licenses, fees and state monitoring

The law sets out 11 types of gambling license. An online casino needs just one of them, issued for five years. Its fee is set at 6,500 minimum wages and is paid for each year of the license term rather than once.

Every licensed operator must also connect to the State Online Monitoring System, a hardware and software system that records bets, payouts and other transactions. When the law was adopted the system did not yet exist, so operators were allowed to start trading and connect within six months of its launch.

Because the capital, guarantee and license fee are all tied to the national minimum wage, their value changes whenever the minimum wage is revised. At 2020 exchange rates, the main upfront commitments looked roughly like this:

Taxation was left out of the 2020 law. Parliament planned to set gambling tax rates once the monitoring system was running, and that open question made many investors cautious about committing capital in the first months.

How the market opened in 2021

The first online license fee reached the state budget in early February 2021, which is widely seen as the practical start of legal online gambling in Ukraine. During 2021 more than 30 online casinos obtained licenses, and license fees brought the budget more than ₴700 million.

The early market had a few clear characteristics:

  • Little foreign capital. Unresolved tax rules and the delayed monitoring system kept most international investors on the sidelines, even though the core licensing terms stayed unchanged.
  • Familiar products. The first licensed sites looked much like international casinos, with games from well-known providers such as Microgaming, Playtech and Evolution and the usual mix of bonuses.
  • Limited payment options. Players could pay with Visa and Mastercard cards or through iBox terminals, but e-wallets and cryptocurrencies were not offered, because the state needs to be able to trace deposits and withdrawals.
  • Low entry points. Minimum deposits were often around ₴50, well below the $10 to $20 minimum many foreign sites ask for.

What to check before you plan a Ukrainian launch

Ukraine's regulatory arrangements have continued to evolve since the first licenses were issued, and the full-scale war that began in February 2022 has reshaped the business environment. Anyone considering the market should confirm the current position on these points before committing:

  • which authority currently issues and supervises licenses, and its application procedure;
  • today's license fees, capital and guarantee amounts, given that they move with the minimum wage;
  • the gambling tax regime that now applies;
  • the status of the State Online Monitoring System and the technical connection requirements;
  • ownership restrictions and the rules on permitted payment methods.
